KROOZ is a ride-share transportation network company (TNC), a technology transportation social network dedicated to providing suitable, alternatively comfortable, reliable rider and hot-shot delivery service via our mobile apps which allows customers with smart-phones to book ride request and or delivery pick-up from any desired location, then routed to KROOZ independent drivers who uses their own cars, picked up the rider/delivery and drive to the destination.

KROOZ allows Users to create a unique personal account online or through the use of our interactive mobile applications.
By using KROOZ you agree to be bound by this Privacy Policy, whether or not you register as a User. If you wish to become a USER ("Driver, Rider, or Delivery Customer"), communicate with other Users and make use of the services, please read this Agreement and indicate your acceptance by following the instructions in the Registration process.

We require all Users ("Driver, Rider, and Delivery Customer") to upload and include his or her original photo, not, just another sort of image.

Additionally, drivers are required to upload the original photos of their Vehicle, which includes: The view of the vehicle showing the LICENSE PLATE either in front or back view, driver side view and the passenger side view of the vehicle. Along with vehicle registration document and active vehicle insurance card images must be upload during the new driver application registration. The car must be currently registered, but the driver name does not have to be on the registration if the driver's name is on the car insurance.

These help us clearly match and pair driver and rider with a clearer and transparent services. If your profile violates this requirement, we'll deactivate your account without further notice.

Krooz, Inc collects different Information created when you use our services
This may include:

• + Depending on the Krooz, Inc. services that you use, and your app settings or device
• + User feedback, such as ratings or compliments.
• + Users providing your information in connection with referral programs.
• + Users requesting services for or on your behalf.

• + Insurance providers (if you are a driver or delivery partner).

Krooz, Inc maintains a zero-tolerance intoxicating substance policy for both drug and alcohol while using krooz platform as independent contract driver or Kroozin as krooz rider. On the ground, if a driver should take prescribed medication that can result in side effects that may be like intoxication, the individual driver is not allowed to operate Krooz apps or drive while intoxicated. And customers are not allowed to board any krooz vehicle type as a rider while under the influence of intoxication.

Any driver found to be violating this intoxicating substance policy should be asked by the rider to STOP the ride and notify Krooz, Inc immediately by contacting us via our toll-free 1 (844) 44 KROOZ or contact our help-desk via our contact us page.

You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. It is the policy of KROOZ to terminate membership privileges of any User who repeatedly infringes copyright upon prompt notification to KROOZ by the copyright owner or the copyright owner legal agent.

You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. It is the policy of KROOZ to terminate membership privileges of any User who repeatedly infringes copyright upon prompt notification to KROOZ by the copyright owner or the copyright owner legal agent.

b. You are solely responsible for the Content that you publish or display (hereinafter) on the Service or any material or information that you transmit to other Members.

c. By posting any Content to the public areas of the Website, you hereby grant to KROOZ the non-exclusive, fully paid, worldwide license to use, publicly perform and display such Content on the Website. This license will terminate at the time you remove such Content from the Website.

d. The following is a partial list of the kind of Content that is illegal or prohibited on the Website. KROOZ reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Service and terminating the membership of such violators. Prohibited Content includes Content that:

i. is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual

ii. Harasses or advocates harassment of another person

iii. Involves the transmission of chain letters or unsolicited mass mailing or spamming

iv. promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, or defamatory.

v. promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files

vi. Contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page)

vii. Provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal info from anyone under the age of 18.

viii. Provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses

ix. solicits passwords or personal identifying information for commercial or unlawful purposes from other users or

x. involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes.

e. You must use the Service in a manner consistent with all applicable laws and regulations.

f. You may not engage in advertising to, or solicitation of, any Member to buy or sell any products or services through the Service. You may not transmit any chain letters or junk email to other Members. Although KROOZ cannot monitor the conduct of its Users off the Website, it is also a violation of these rules to use any information obtained from the Service to harass, abuse, or harm another person, or to contact, advertise to, solicit, or sell to any Member without their prior explicit consent. To protect our Members from such advertising or solicitation, KROOZ reserves the right to restrict the number of emails which a User may send to other User in any 24-hour period to a number which KROOZ deems appropriate in its sole discretion.

g. You may not cover or obscure the banner advertisements on your personal profile page, or any of our website pages via HTML/CSS or any other means.

h. Any automated use of the system, such as using scripts to add friends, is prohibited

i. You may not attempt to impersonate another user or person who is not a member of this website

j. You may not use the account, username, or password of another Member at any time nor may you disclose your password to any third party or permit any third party to access your account.

k. You may not sell or otherwise transfer your profile.

This E-SIGN Disclosure ("Disclosure") applies to all communications or disclosures that we are legally required to provide to you in writing in connection with your membership with Krooz, Inc., platform (KROOZ) and any related products and services ("Communications"). This Disclosure supplements and is to be construed in accordance with the terms contained in the Terms and Condition; Privacy Policy; as the ("Agreement").

• 1. Scope of Communications to Be Provided in Electronic Form. When you use the Krooz platform or service to which this Disclosure applies, you agree that we may provide you with any Communications in electronic format, and that we may discontinue sending paper Communications to you, unless and until you withdraw your consent as described below. Your consent to receive electronic communications and transactions includes, but is not limited to:

• 2. Method of Providing Communications to You in Electronic Form. All Communications that we provide to you in electronic form will be provided either (a) via e-mail if you have elected to receive e-mail messages from us (b) to the extent permissible by law, and in accessing the Krooz platform (the "Website, Mobile Applications, and Services").


• 3. How to Withdraw Consent. You may withdraw your consent to receive Communications in electronic form at any time by contacting us at 1-844-44-KROOZ. If you do withdraw your consent, we will send subsequent Communications regarding to your account or transaction to you in writing to the most current mailing address we have for you in our records, mailing and processing fee could apply. In the meantime, you will continue to receive Communications in electronic form. If you withdraw your consent, the legal validity and enforceability of prior Communications delivered in electronic form will not be affected.


• 4. How to Update Your Records. It is your responsibility to provide us with a true, accurate and complete e-mail address (mandatory for all users both customers and drivers), your contact information, and other information related to this Disclosure and your Krooz Account, and to maintain and update promptly any changes in the account information through your account dashboard on Krooz apps and or at: HUB You can update your account information (such as your e-mail address, etc.,) through the website; in the apps or by contacting us at 1-844-44-KROOZ.


• 5. Hardware and Software Requirements to access, view, and retain electronic Communications that we make available to you, you must have:
  an Internet browser that supports 128-bit encryption or higher; enough electronic storage capacity on your computer's hard drive or other data storage unit; an e-mail account with an Internet service provider and e-mail software to participate in our electronic Communications programs if you have elected to receive e-mail messages from us; a personal computer (for PCs: Pentium 120 Hhz or higher; for Macintosh, Power Mac 9500, Power PC 604 processor 120-MHz Base or higher), operating system; mobile devices and telecommunications connections to the Internet capable of receiving, accessing, displaying, and either printing or storing Communications received from us in electronic form via a plain text-formatted e-mail or by access to our web site using one of the browsers specified above; and Adobe Acrobat Reader Version 8.0 or higher.


• 6. Requesting Paper Copies. We will not send you a paper copy of any Communication, unless you request it, or we otherwise deem it appropriate to do so. • 7. Communications in Writing. All Communications in either electronic or paper format from us to you will be considered "in writing." You should print or download for your records a copy of this Disclosure and any other Communication that is important to you.


• 8. Federal Law. You acknowledge and agree that your consent to electronic Communications is being provided in connection with a transaction affecting interstate commerce that is subject to the federal Electronic Signatures in Global and National Commerce Act ("E-SIGN Act"), and that you and we both intend that the Act apply to the fullest extent possible to validate our ability to conduct business with you by electronic means.


• 9. Termination/Changes. We reserve the right, in our sole discretion, to discontinue the provision of your electronic Communications, or to terminate or change the terms and conditions on which we provide electronic Communications. We will provide you with notice of any such termination or change as required by law.


• 10. By joining the Krooz, Inc., platform as a customer; driver, and by continuing to use the services it implores you solely agreed to the full extent of this E-Sign agreement.

The Service is only available to individuals who are at least eighteen (18) years old. You represent and warrant that if you are an individual, you are at least eighteen (18) years old, that you are fully able and competent to enter into the terms and conditions set forth in this and other agreements on the Krooz platform, and that all registration information you submit is truthful, accurate and complete. If you are accessing the Krooz platform and/or using the Service on behalf of an entity, such as your employer or a company you work for or control, you warrant and represent that you have the legal authority to bind that entity to these Privacy and Terms of Use.

The Krooz, Inc., platform is maintained in the United States of America. By accessing Krooz, you consent to and authorize the export of Personally Identifiable Information to the United States of America and its storage and use as specified in this Privacy Policy and Terms.

This Privacy and Terms Notice shall be governed by, construed and entered in accordance with the laws of the State of Texas applicable to contracts deemed to be made within such state, without regard to choose of law or conflict of law provisions thereof. All disputes with respect to this Privacy and Terms Notice shall be brought and heard either in the Texas State Courts located in the county of Dallas, Texas, or the federal district court in the state of Texas. You consent to the in personal jurisdiction and venue of such courts.

YOU HEREBY WAIVE YOUR RIGHT TO A TRIAL BY JURY WITH RESPECT TO ANY CLAIM, ACTION OR PROCEEDING, DIRECTLY OR INDIRECTLY, ARISING OUT OF, OR RELATING TO, THIS AGREEMENT TO THE FULLEST EXTENT PERMITTED BY LAW.

KROOZ is not responsible for any incorrect or inaccurate Content posted on the Website or in connection with our interactive mobile applications and the Service provided, whether caused by users of the KROOZ Website, Members or by any of the equipment or programming associated with or utilized in the Service. KROOZ, Inc is not responsible for the conduct, whether online or offline, of any user of our applications or Users of the Service. KROOZ assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any user or Member communication.

KROOZ is not responsible for any problems or technical malfunction of any mobile device, telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or at any Website or combination thereof, including any injury or damage to users and/or Members or to any persons computer related to or resulting from participation or downloading materials in connection with the KROOZ platform and or in connection with the Service. Under no circumstances shall KROOZ, Inc be responsible for any loss or damage, including personal injury or death, resulting from the use of KROOZ platform and applications or the Service or from any Content posted on the Website or transmitted to Users, or any interactions between users of KROOZ platform, whether online or offline. KROOZ platform and or Website and the Service are provided AS-IS, and KROOZ, Inc expressly disclaims any warranty of fitness for a particular purpose or non-infringement. KROOZ cannot guarantee and does not promise any specific results from use of KROOZ apps and/or the Service.

IN NO EVENT SHALL KROOZ, INC BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR THE SERVICE, EVEN IF KROOZ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN. LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO AMOUNT PAID, IF ANY, BY YOU TO KROOZ, INC FOR THE SERVICE DURING THE TERM OF USE.

This Agreement is accepted upon your use of KROOZ and is further affirmed by you becoming a User of the Service. This Agreement constitutes the entire agreement between you ("Driver","Rider", "Krooz Kuisine Customer") and KROOZ regarding the use of the social transportation service and/or the Service. The failure of KROOZ to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no legal or contractual effect. Please contact us with any questions regarding this Agreement.
